Workforce Accommodation

Housing your workers is a licensing decision before it is a logistics one.

Since 1 September 2020, Act 446 has applied to employers across almost every sector in Peninsular Malaysia and Labuan, where for the thirty years before that it reached only estates and mines. Accommodation has to be certified by the Director General of Labour before anyone is housed in it, and the duty sits on the employer as well as on the accommodation provider. Booking beds with someone else does not move the liability, it only changes who has to hold the certificate. We operate certified workforce accommodation with the catering, transport, welfare and discipline management that keeps a resident workforce fit to turn up for shift.

How worker accommodation is regulated in Malaysia, and where employers get caught

Act 446 now reaches almost every employer, not only estates
The 2019 amendment renamed it the Employees’ Minimum Standards of Housing, Accommodations and Amenities Act 1990 and widened it from estates and mines to employers generally. It has been in force across Peninsular Malaysia and Labuan since 1 September 2020. Employers who sat outside its scope before 2020 are often still running their accommodation as though they do.

The Certificate for Accommodation is a precondition, not paperwork
Section 24D requires accommodation to be certified by the Director General of Labour before employees are housed in it, on an application that goes in with building plans, a management plan and safety documentation. The penalty on conviction reaches RM50,000 for each offence. A building that meets every physical standard is still non-compliant until the certificate is actually issued.

Outsourcing the housing does not outsource the duty
The Act places obligations on the employer and on the centralised accommodation provider, side by side. An employer who books beds with a provider holding no current certificate carries the exposure along with them, and finds out at the inspection rather than at the contract stage. Ask to see the certificate and its expiry date before the first worker moves in.

Attrition on a project is usually a welfare problem before it is a pay problem
Food the workforce will actually eat, somewhere to wash and dry clothes, a prayer space, a way to send money home, and a route to care when someone falls ill. These are the things residents judge a posting on. Sites that treat them as extras lose workers to sites that do not, and replacing a mobilised worker costs more than the amenity ever did.

What to check before you place workers in a hostel

Ask for the Certificate for Accommodation itself, with its expiry date, and confirm that the name on it matches the company that will actually operate the building. A certificate held by a landlord, a related company or a previous operator does not cover the arrangement you are entering into, and that distinction is exactly what an inspection turns on.

Capacity is not simply a bed count. Washroom, water and canteen provision all scale with occupancy, so a block that is comfortably compliant at 60 per cent occupancy can drop below standard the week your project peaks. Work the numbers against peak headcount and the shift pattern, because a single canteen sitting that works for a day shift falls apart when three rosters overlap.

Settle the management side in writing before mobilisation: who handles resident discipline, who answers the phone at two in the morning, how often maintenance is scheduled, and what happens when someone is unfit to work and has to be kept apart from the rest. These are the questions that decide whether accommodation stays a solved problem or becomes a weekly one.

Certified accommodation, catering, welfare and site management as one service

Accommodation is run as a managed service rather than a room booking, whether the workers are ours under a manpower contract or your own. Figures below describe our Pengerang facility, which is operating today and serves as the reference standard for placements elsewhere.

Purpose-built worker accommodation operated to Act 446 standards under a Certificate for Accommodation. Our Pengerang facility runs two three-storey blocks, 72 rooms to a block at 24 rooms a floor and 16 residents to a room, giving 1,152 beds per block and 2,304 across the site. A 50-pax prayer room, a multi-purpose training and reading room used for weekend sessions, and recreation and outdoor sports areas. The training room also serves toolbox talks and site inductions where a project wants them run before the bus leaves.
